The Family Law Portal is our expert, friendly and approachable Department that deals with:

Children Law

We understand that the needs of your children will be paramount to you when considering the impact of the breakdown of a relationship and/or marriage.

Our expert team advise on all children law issues including Child Arrangements Order, Prohibited Steps Order, Specific Issue Order,  Parental Responsibility disputes, Special Guardianship Orders, Adoption, child abductions and relocation applications. More here >

Divorce and Separation

Our expert team will help guide you through your divorce and separation considering all elements including but not limited to the children and financial settlements.

To apply for a divorce you must have been married for at least one year. The ground for divorce is the irretrievable breakdown of the marriage. This must be based upon one of the five following facts:

  • Adultery
  • Unreasonable behaviour
  • Desertion for a period of more than two years
  • Two years separation by consent
  • Five years separation

Domestic Abuse

We understand the strength and courage it takes to seek help to get out of an abusive relationship as no one should have to suffer from domestic abuse, harassment or violence.

Our special family lawyers are all members of Resolution, an organisation committed to the constructive resolution of family disputes through non-confrontational communication.

We can assist in applying for Orders such as a Non-Molestation Order, Occupation Order and a Harassment Order.

Financial Issues

When ending a marriage or civil partnership, you will need to real a formal financial settlement even if you had kept your finances separate. If a financial settlement is not sought, your ex-partner may be able to bring a future financial claim against you. We strongly advice that even if you have reached a financial settlement that a Consent Order is drafted (setting out the agreement you have reached).

If you are unable to reach an agreement, our specialist family lawyers can advice you on a likely fair division of assets taking into the account the needs of each person (respective ages, future earning capacity, current assets, liabilities, the current lifestyle etc).

High Net Worth (HNW) individuals

Our expert family law specialists have experience of dealing with High Net Worth individuals (HNW) with their divorce and financial settlement which includes considering assets including trusts, business and/or domestic/international assets. We also advise on remedial applications (orders to locate hidden assets, freezing orders and committal applications for non-disclosure).

Wealth Protection - Cohabitation Agreement, Pre-/Post Nuptial Agreements

Our specialist family lawyers offer advice on all aspects of wealth protection including cohabitation agreement, pre and post nuptial agreements. We understand that no one wants to believe that their relationship or marriage will end and these arrangements can be considered unromantic or dooming a relationship/marriage to end. Sadly, the reality is that relationships and marriages to do end so if you have an agreement in place it can reduce/eliminate any further animosity that is often experienced during a breakdown of a relationship/marriage and reduce further costs and time.

In the UK, cohabiting couples are not afforded the same level of protection by the law as married couples. It is often this misconception that people believe that if they have been a cohabiting couple for a period of time, they became ‘common law’ spouses and have the same rights as married couples.

A prenuptial agreement is entered into before a marriage and enables couples the opportunity to consider their current financial positions and their plans for a financial settlement should the marriage end.

A post nuptial agreement is entered into after a couple is married and living together allowing them to plan their finances should the marriage end.

To understand your rights and consider obtaining an agreement in respect of your property, pensions, savings, investments and children contact one of our expert family lawyers.
