Children and Parental Disputes

Working out what is best for the children when a relationship or marriage ends can be extremely difficult for all parties involved. We handle every matter involving children with maximum sensitivity, our core approach being the mental health of our clients and their children separates us from other law firms.

Every family is different so requires a unique approach to ensure that the children’s best interests are protected, their well-being considered, and their various needs are addressed. It is usually best for your family if any disputes involving your children can be resolved through agreement between you and your partner, and ideally through mediation rather than the stress, formality and cost of the Courts.

However unfortunately sometimes Court is necessary and there are many types or orders available such as Child Arrangements Orders, Parental Responsibility Orders, Specific Issue Orders, Prohibited Steps Orders and Special Guardianship Orders.

We are experienced in all types of issues involving children and will always work to safeguard their interests whether disputes over paternity, living arrangements, access (by parents or grandparents), schooling, maintenance, relocation or parental alienation.

Domestic Abuse

There is no legal definition of domestic abuse but the common definition relied upon by professionals is: as an incident or pattern of incidents of controlling, coercive, threatening, degrading and violent behaviour, including sexual violence, in the majority of cases by a partner or ex-partner, but also by a family member or carer.

Domestic Abuse can include:

  • Coercive control (a pattern of intimidation, degradation, isolation and control with the use or threat of physical or sexual violence)
  • Psychological and/or emotional abuse
  • Physical or sexual abuse
  • Financial or economic abuse
  • Harassment and stalking
  • Online or digital abuse

How to protect yourself if you are a victim of domestic abuse:

  • Obtain disclosure if you have concerns about whether a new, former or existing partner has a violent past – under ‘Clare’s Law’ (Domestic Violence Disclosure Scheme), If records show that you may be at risk of domestic abuse from a partner, the police will consider disclosing the information. To make an application for disclosure under ‘Clare’s Law’ you need to contact the police directly
  • Seek legal advice to consider you options – considering whether to seek immediate protection via a refuge. We work closely with a number of charities/organisations like Hestia, Solace Women’s Aid and Rights of Women.
  • Apply for an Injunctive Order – Non-Molestation Order, Occupation Order, Protection under Harassment Act 1997
